Woman Files Wrongful Death Lawsuit against Man Accused of Killing Her Husband

A woman in Binghamton, New York, has filed a wrongful death lawsuit against the man who was already charged with the murder of her husband.

According to State Police, Dylan Schmiel, 23, was speeding when he struck and killed David Decker, 73, while driving on Interstate 81 North.

Schmiel is facing charges of murder, homicide by vehicle and homicide by vehicle while driving under the influence.

The lawsuit cites negligence and recklessness on Schmiel’s part, who was found to have had marijuana in his system.

The suit also seeks damages for Judith Decker’s loss of her husband’s support, society and companionship.
