Widow Files Lawsuit against Accused Killer
A woman in Endicott, New York, has filed a wrongful death lawsuit against the driver who is accused of killer her husband.
The lawsuit was filed Sept. 24 in the State Supreme Court of Broome County, accusing Dylan R. Schmiel of driving with negligence and recklessness, causing the death of David Decker.
The attorney of Decker’s widow, Judith Decker, said that Schmiel did not use any form of care before the crash.
Schmiel was speeding when he collided with Decker along Interstate 81 in Pennsylvania.
Schmiel acted with “sustained, purposeful recklessness” while driving under the influence of marijuana, according to an investigation by Pennsylvania state police.
