Man Files Lawsuit against Police, City for Head Injury
A man has filed a lawsuit against an officer and the city of South Bend, Michigan, for a head injury and the alleged violation of his constitutional rights.
Tom Stevens was stopped by Officer Aaron Knepper for allegedly driving without headlights on March 25, 2014. According to poilice, Stevens resisted arrest violently against Knepper before being subdued. The lawsuit claims that Stevens never stuck the officer.
Stevens’s attorney, Jeff Kimmell, claims that Knepper slammed Stevens to the ground and punched him repeatedly, hospitalizing him with a “slow brain bleed” for several days.
The lawsuit alleges that Knepper and the city violated Stevens’s Fourth Amendment and 14th Amendment rights against unlawful arrest, unlawful use of force and malicious prosecution.
